Welcome to Nexium Dynamics. These Terms & Conditions ("Terms") govern your access to and use of our website, services, applications, and products. By using our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

By engaging with Nexium Dynamics for App Development, Game Development, AI Movie Production (Pantom Vision Studios), or Freelancing & IT Services, you acknowledge that you have read, understood, and agreed to comply with these terms.

1. General Terms for All Services

These general terms apply to all Nexium Dynamics services, including App Development, Game Development, Pantom Vision Studios, and Freelancing & IT Services.

  • You must be at least 18 years old to use our services. If you are under 18, you must have parental or guardian consent as per The Indian Contract Act, 1872.
  • You agree to provide accurate, current, and complete information when using our services.
  • We reserve the right to modify, suspend, or discontinue any service at any time, with or without notice.
  • Any unauthorized copying, reproduction, or modification of our services, apps, games, or digital content is strictly prohibited under The Copyright Act, 1957.
  • We do not tolerate hacking, abuse, or misuse of our services. Violators may be banned, reported, or legally prosecuted under The Information Technology Act, 2000.
  • We do not guarantee 100% uptime of our services and are not liable for any technical disruptions.

Service-Specific Terms & Conditions

2. App Development – Terms of Using Our Apps

By downloading, installing, or using our apps, you agree to the following:

2.1 Ownership & Usage Rights

  • Our apps are provided for personal and business use only.
  • You cannot modify, resell, redistribute, or reverse-engineer our applications, as per The Indian Patent & Copyright Law.
  • Any custom-built app remains the property of the client upon full payment, but Nexium Dynamics retains the right to use it in portfolio showcases.

2.2 Privacy & Data Protection

  • Some apps may collect user data for analytics and security purposes.
  • Your data is handled according to our Privacy Policy and in compliance with the upcoming Personal Data Protection Bill.
  • We do not sell or share personal data with third-party advertisers.

2.3 No Warranty

  • Our apps are provided "as is", without any guarantees of being error-free or uninterrupted.
  • We are not responsible for device compatibility issues or data loss.

3. Game Development – Terms of Playing Our Games

By playing our games, you accept the following conditions:

3.1 User Conduct & Fair Play

  • Cheating, hacking, using bots, or exploiting bugs is strictly prohibited. Violators will be banned permanently.
  • Nexium Dynamics is not responsible for in-game disputes, lost progress, or digital goods lost due to violations.

3.2 In-Game Purchases

  • Virtual items (coins, skins, weapons, characters, etc.) are non-refundable once purchased.
  • Under the Consumer Protection Act, 2019, we ensure transparent pricing for in-game purchases.

3.3 No Liability for Loss

  • Nexium Dynamics is not responsible for loss of progress, in-game items, or saved data due to account bans or system failures.

4. Pantom Vision Studios – Terms for AI Movie Creation

4.1 Ownership & Licensing

  • Final movie projects belong to the client after full payment.
  • Nexium Dynamics retains the right to use parts of the project in marketing and portfolio showcases.
  • If third-party assets (music, footage, effects) are used, the client must ensure they have the appropriate licenses as per the Copyright Act, 1957.

4.2 No Plagiarism Policy

  • AI-generated content must comply with intellectual property laws and cannot contain copyrighted material.

4.3 Revisions & Edits

  • Clients can request up to 3 revisions within 7 days of project delivery.
  • Additional edits beyond this period may require an extra charge.

5. Freelancing & IT Services – Terms of Service

5.1 Payment & Delivery

  • Payments must be made upfront through Upwork, Fiverr, or direct transactions.
  • All transactions must comply with Indian taxation laws (GST & Income Tax Act).

5.2 Revisions & Refunds

  • Two free revisions per project. Additional revisions may require an extra charge.
  • Refunds are only available if we fail to deliver as per the agreed contract.

5.3 Rights & Ownership

  • Clients receive full rights to the delivered work after final payment.
  • Unauthorized reselling, modification, or redistribution is prohibited.

6. Governing Law (As Per Indian Laws)

These Terms & Conditions are governed by the laws of India, specifically under:

  • The Information Technology Act, 2000 – Covers digital contracts, privacy, and cybersecurity.
  • The Consumer Protection Act, 2019 – Protects consumer rights in digital transactions.
  • The Indian Contract Act, 1872 – Governs business agreements and service terms.
  • The Copyright Act, 1957 – Protects our intellectual property rights.

7. Termination of Services

We reserve the right to:

  • Terminate accounts, subscriptions, or access if users violate these terms.
  • Remove content that is illegal, harmful, or violates copyrights.
